The use of any of our services & website implies a complete acceptance of these T&C.

General

1. Definitions

1.1 The ‘Company‘ refers to The Spanish Factory™.

1.2 The ‘Customer/Student‘ refers to the person in whose name the booking is made and will include the person or persons on whose behalf the same is made.

1.3 ‘Force Majeure‘ refers to any event outside the business’s control which prevents the prompt performance of its obligations, including teacher’s illness, extreme weather conditions, public transport strikes, civil strife, etc.

1.4 ‘Tutor/Teacher‘ refers to the person in charge of the teaching of Spanish.

1.5 ‘T&C‘ refers to the Terms & Conditions of this company.

2. Acceptance and acknowledgment of these terms

2.1 These T&C are between the company and the customer(s).

2.2 The knowledge of the existence of these T&C is exclusively the responsibility of the customer and they are considered as understood and accepted once the customer has agreed with the company to take part in any of our offered services (including the Free Spanish Lesson offer).

2.3 If the customer decided not to continue after the Free Spanish Lesson offered by the company, the customer would be liberated entirely from the totality of the clauses of this contract apart from that of clause 8.3 and 8.4. These clauses remain in effect for a 12 month period.

2.4 The purchase of any service offered by the business implies the entire acceptance of each and every one of the clauses of these T&C.

2.5 The breaking of any clause of this contract, or any flair which goes against the cordial nature of this contract could result in the unilateral cancellation of the service without a refund.

2.6 This company reserves the right to accept, limit or decline requests for the services offered where and with whom we see cause to.

3. Online Customer Account

3.1 By booking any of our paid or unpaid offered services, the customer, if he/she chooses so, agrees (1) to create an online digital account on the company’s webpage www.thespanishfactory.co.uk and, (2) to receive digital correspondence in order to manage this account and the service contracted, and (3) to keep their account security details secret at all times.

3.2 The company reserves the right to terminate the customer’s online account at its sole discretion if considered appropriate.


Tuition Service

4. The Service

4.1 The company offers Spanish teaching services in a pertinent location which is mutually convenient both for the teacher/company and the customer. Generally this means the house or office of the customer, or any of our venues.

4.2 The time and date of the classes should be agreed upon mutually between the customer and teacher, and these should be worked out according to the following time frame: from Monday to Friday between 9am and 9pm, and Saturdays between 9am and 6pm.

5. Rights of the Customer

5.1 The customer has the right to apply to this company for a change of teacher if they consider that the tuition process fails to meet their expectations. This should be requested via e-mail.

5.2 The customer can choose the educational mode which best suits their interests and has complete freedom to decide/modify the academic content of the class.

5.3 The customer has the right to pause their tuition process at any time, understanding that when pausing the lesson plan for a longer period of time, the company may not be able to provide the same teacher as before.

6. Rights of This Company

6.1 This company has the right to decline a change of teacher if:

  • There are no other teachers that work in the area;
  • None of the teachers who work in the area wish to take charge of the customer;
  • If this company understands that this change of teacher is not based upon a purely academic qualm.

6.2 Although this is not usual, the company reserves the right to change the customer’s teacher if necessary. The customer understands that the purchase of classes does not link the consummation of these tuition hours with a specific teacher but with whichever teacher the company provide.

7. The Company’s Obligations

7.1 Once the customer has set up their Spanish Tuition payment plan, the company is committed to provide the service that the customer has contracted, following the steps described in these terms, and published on our main website.

7.2 The company is committed to provide a teacher who materialises the tuition hours acquired by the customer as long as there is no force majeure impeding them from adhering to this commitment.

8. Obligations of the Customer

8.1 The customer is committed to the registration, in writing, with their name and signature, of all the hours that are covered in their classes in order to create a memorandum of all the tuition hours that have been completed.

8.2 The customer is committed to pre-book all lessons in the company’s online booking calendar always according to their teacher’s availability.

8.3 The customer is forbidden to set up/propose or insinuate unilateral agreements other than those already contracted, as well as any other Spanish-related service with the assigned teacher other than those already contracted, in any way; neither before the Free Spanish Lesson nor after this, or in any other time throughout the learning process, or in the 12 months which follow the customer’s last Spanish class.

8.4 In the case of the customer breaking the clause 8.3, they will be subject to a fine of £1000 in compensation to this company which must be paid within 15 days after the company’s request.

9. Payments

9.1 The Free Spanish Lesson which we offer will not, under any circumstances, be charged, whether the customer decides to continue with our services or not.

9.2 The payment of your classes should be carried out directly to the company, through our website by electronic online payments.

9.3 The customer accepts the payment methods proposed by the company.

9.4 The price of all the tuition services offered could have a final raise of between 2% and 5% due to concepts derived from the electronic payment fee.

9.5 The prices of Spanish Tuition Plans may be modified without previous warning by the executive body of the company and this modification will apply only when setting up a new payment plan, never with the payment plan already set up.

10. Changing and Cancellation of Classes

10.1 In the case of a customer deciding to cancel a class already booked or arranged with their teacher, the customer should warn the teacher within 12 hours time. In the case of not informing the teacher within this time margin, the company could choose to class the lesson as completed, depending on whether the cancellation has affected in any way the interests of the teacher. The customer accepts that the service for which they have paid, personal tuition sessions, begins at a minimum of 12 hours before the lesson takes place, therefore respecting the lesson preparation time and all the work made by the teacher.

10.2 In order to cancel a lesson already booked or arranged with the teacher, the customer must contact his/her assigned teacher directly by writing to their personal business e-mail or by calling on their personal business telephone line. This contact information is set in the e-mail confirmations of the booked lessons.

10.3 The customer can pause their entire lesson plan at any time if the customer decides to put their tuition process on stand-by, or has decided to terminate the tuition process.

10.4 The customer must pay off any unpaid lessons before the company can process the request of pausing or cancelling the customer’s lesson plan.

11. Sessions

11.1 Once the customer has acquired/set up a lesson plan to carry out their educational process, they understand that they are committed to carry out the lessons as per their selected tuition plan, and that the duration of the tuition sessions should be spread according to the criteria described below:

  • 1-2-1 lessons: A minimum of 2 hours per weekly session.
  • 2-2-1 lessons: A minimum of 2 hours per weekly session.
  • Mini-Group lessons: A minimum of 2 hours per weekly session
12. Fair Refund Policy

12.1 If the customer has already paid for a lesson within their chosen payment plan/package, but was unable to attend the lesson, the customer has the right to carry out the undone lesson, providing that, the teacher was advised of the cancellation on time as described in the clause 10.1 of these T&C or if such undone lesson was never previously booked.

12.2 The company cannot provide refunds for the classes that have been already carried out or classed as complete by the company as per the clause 10.1 of these T&C.

12.3 Once a Lesson Package has been bought by the customer, the company cannot provide a refund for such payment, understanding that the large variety of one-off Lesson Packages offered provide a full flexibility to the customer and that the teacher's work and lesson preparation starts once a package has been bought. 


Intensive Service

13. Enrolment

13.1 Before enrolling, the customer is required to review their personal commitments to be able to attend the programmed lessons.

13.2 All available group courses on which the customer can enrol and their exact timetables are advertised on the company’s main website www.thespanishfactory.co.uk.

14. Teachers and Classes

14.1 The company reserves the right to reassign teachers after the start date of the course. The company cannot guarantee that customers and their former classmates will be placed into the same course if there are parallel courses of the same level running at the same time.

14.2 A minimum of 6 students is required for courses to take place. Usually, the minimum class size is 6 students and the maximum is 10.

14.3 The company cannot open a course with less than 6 students enrolled. The company makes every effort to run all of our courses as advertised, but cannot guarantee that courses failing to meet the minimum student number will run.

14.4 The company reserves the right to cancel or postpone courses for which fewer than 6 students have enrolled. Customers who are enrolled on a cancelled course will be notified and could choose to be fully refunded or placed to the next available course.

14.5 The company is committed to provide the course acquired by the customer as long as there is no force majeure impeding them from adhering to this commitment.

15. Attendance

15.1 Attendance is a complete responsibility of the customers. If a customer does not attend a programmed class, the lesson cannot be made up at another time.

15.2 Once classes begin the company cannot transfer customers to a following course.

16. Material

16.1 The company will supply all appropriate teaching materials for the level and length of the course, unless stated otherwise.

16.2 Materials may consist of a coursebook, standard stationary and additional supporting documentation.

17. Booking & Payments

17.1 Customers can reserve a place in a group course by making an online payment from the company’s main website www.thespanishfactory.co.uk.

17.2 The customer accepts that the course enrolment is made through a one-off upfront credit/debit card payment.

18. Fair Refund Policy

18.1 The customer has the right to cancel their enrolment and get a full refund, providing that the refund has been requested at least 7 days (168 hours) before the course starts.

18.2 No refund can be provided if the cancellation request is made less than 7 days before the course starts or once the course has already started, understanding that (1) the resources of the customer’s enrolment are equal to their course fees whether they attend just one session or the full course and (2) the customer left no margin for the company to fill their place with another customer.

18.3 In the event that the company received a course cancellation request less than 7 days from the course start, the company may process the cancellation and provide the appropriate refund only if the company is able to find another student to fill this empty place, something that cannot be guaranteed and depends on whether any students from the waiting list wish to take his/her place on a short notice.

18.4 The company cannot accept cancellations by phone or post. The customer can request a cancellation in writing sending an e-mail.

18.5 Due to the nature of the courses, the company cannot, in any event, prorate classes or transfer unused class time to another course.


Corporate Service

19. The Service

19.1 The company offers corporate Spanish language training services at the customer’s office or a mutually agreed other corporate location.

19.2 The company is fully committed to provide the contracted service acquired by the customer as long as there is no force majeure impeding them from adhering to this commitment.

19.3 The time and date of the lessons/workshops should be agreed upon mutually between the customer and the company.

19.4 Once the date, time and place in which the lessons/workshops will take place have been arranged, these can not be unilaterally modified unless this is done through another agreement between the customer and the company.

19.5 The company reserves the right to change the customer’s teacher if necessary. The customer understands that the purchase of a corporate course does not link the consummation of these lessons with a specific teacher but with whichever teacher the company provide.

20. Bookings

20.1 All corporate service bookings are made through the company’s main website or an online invoice by an upfront one-off debit/credit card payment or another mutually agreed payment method that the company can provide.

21. Lessons / Workshops

21.1 Once the customer has acquired a corporate course, they understand that they are committed to carry out the lessons as per their agreed timetable, and that the duration of the sessions should be a minimum of 1 hour per session.

21.2 In the case of a customer deciding to cancel a class already arranged with their teacher, the customer should warn the teacher within 12 hours time. In the case of not informing the teacher within this time margin, the company could choose to class the lesson as completed, depending on whether the cancellation has affected in any way the interests of the teacher. The customer accepts that the service for which they have paid, begins at a minimum of 12 hours before the lesson takes place, therefore respecting the lesson preparation time and all the work made by the teacher.

21.3 In order to cancel a lesson already booked or arranged with the teacher, the customer must contact their assigned teacher directly by writing to their personal business e-mail or by calling on their personal business telephone line. This contact information is set in the ‘My Teacher’ section of the customer’s online account and in the e-mail confirmations of the booked lessons.

22. Fair Refund Policy

22.1 The customer has the right to cancel the corporate course and get a full refund, providing that the course cancellation has been requested at least 7 days (168 hours) before the programmed course start.

22.2 A processing fee of £25 will be deducted from the full refund amount in the event that the cancellation request is made less than 7 days before and up to 48 hours before the programmed course start.

22.3 No refund can be provided if the service cancellation is made less than 48 hours before the agreed service start or once the corporate course has already started.

22.4 The company cannot accept cancellations by phone or post. The customer can request a cancellation in writing by sending an e-mail or through the ‘My Support’ section in the customer’s online account.
